I. Privacy Policy

1.1 Data Controller. DigitalCreativexLab, registered at 69002, 12 Rue de la République, Lyon, France, is the data controller responsible for the processing of personal data collected through this website.

1.2 Data Collection. We collect personal data you voluntarily provide through our contact forms, including your name, email address, and project details. This data is collected solely for the purpose of responding to your inquiry and delivering requested services.

1.3 Legal Basis. Processing is based on your explicit consent (Article 6(1)(a) GDPR) and the necessity to perform pre-contractual measures at your request (Article 6(1)(b) GDPR).

1.4 Data Retention. Personal data is retained for a maximum of 24 months from the date of collection, or until the purpose for which it was collected has been fulfilled, whichever occurs first.

II. Terms of Service

2.1 Acceptance. By accessing or using the services of DigitalCreativexLab, you agree to be bound by these Terms of Service. If you do not agree, you must discontinue use immediately.

2.2 Scope of Services. DigitalCreativexLab provides digital innovation consulting, rapid design prototyping, interactive technology development, and immersive interface design services as described on our website.

2.3 Project Engagement. All projects begin with a signed statement of work (SOW) defining scope, deliverables, timelines, and pricing. Changes to scope require written approval and may result in adjusted pricing.

2.4 Intellectual Property. Upon full payment, all deliverables created specifically for the client are transferred to the client. DigitalCreativexLab retains ownership of pre-existing tools, frameworks, and methodologies used in service delivery.

2.5 Confidentiality. Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives termination for a period of 36 months.

2.6 Limitation of Liability. DigitalCreativexLab's total liability shall not exceed the total fees paid for the specific service giving rise to the claim. We shall not be liable for indirect, incidental, or consequential damages.

2.7 Termination. Either party may terminate with 30 days written notice. Work completed prior to termination shall be compensated proportionally. Outstanding invoices remain due upon termination.

III. Cookie Policy

3.1 What Are Cookies. Cookies are small text files placed on your device when you visit our website. They help us recognize your browser and remember certain preferences.

3.2 Essential Cookies. We use strictly necessary cookies for website functionality, session management, and security. These cookies do not require consent under the ePrivacy Directive as they are essential for the service requested by you.

IV. Refund Policy

4.1 Advance Payments. Advance payments are non-refundable once work has commenced on the corresponding project milestone. Refund eligibility is calculated based on work completed vs. total project scope.

4.2 Cancellation Before Start. If a project is cancelled before any work has begun, a full refund of the advance payment will be issued within 14 business days.

4.3 Partial Refunds. If a project is terminated mid-execution, a proportional refund will be calculated based on the percentage of undelivered milestones as defined in the signed statement of work.

4.4 Deliverable Disputes. If a delivered milestone does not meet the specifications defined in the SOW, DigitalCreativexLab will implement revisions at no additional cost within 14 days of notification. If revisions cannot resolve the issue, a partial refund will be negotiated in good faith.

4.5 Refund Process. Refund requests must be submitted in writing to [email protected] within 30 days of the invoiced date. Approved refunds are processed within 14 business days to the original payment method.

4.6 Exceptions. No refunds are issued for completed and accepted deliverables, or for delays caused by the client's failure to provide required materials, feedback, or access within agreed timelines.
